Terms of Service

1. Acceptance of Terms

By accessing or using the App you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

2. Eligibility

You must be at least 16 years old to create an account. By using the App you represent that you meet this requirement. If you are under 18, you confirm that a parent or guardian has reviewed and consented to these Terms on your behalf.

3. Your Account

You are responsible for maintaining the confidentiality of your login credentials. You agree not to share your account with others or create accounts on behalf of third parties without authorisation.

You must provide accurate, current, and complete information when registering. We reserve the right to suspend or terminate accounts found to contain false information.

4. Permitted Use

You may use the App to:

• Discover and organise community car cruises
• Share build updates, photos, and modifications
• Buy and sell vehicles and automotive parts via the Marketplace
• Connect with other car enthusiasts
• Promote an automotive-related business

All use must comply with Australian law and our Community Guidelines.

5. Prohibited Conduct

You must not:

• Post content that is illegal, defamatory, hateful, harassing, or discriminatory
• Organise or promote street racing, burnouts on public roads, or other dangerous driving activities
• Sell stolen vehicles or parts, or misrepresent listings
• Impersonate another person or business
• Scrape, reverse-engineer, or copy the App's content or code
• Attempt to gain unauthorised access to any system or account
• Spam, phish, or distribute malware
• Circumvent age or geographic restrictions

6. User Content

You retain ownership of content you post ("User Content"). By posting, you grant us a worldwide, royalty-free, non-exclusive licence to use, reproduce, modify, display, and distribute your User Content solely for the purpose of operating and improving the App.

You are solely responsible for your User Content. We do not endorse User Content and cannot review all of it. We reserve the right to remove any content that violates these Terms or our Community Guidelines without notice.

7. Marketplace

Apex Society provides a platform for users to list and find vehicles and parts. We are not a party to any transaction between buyers and sellers.

Sellers must accurately describe items and are responsible for honoring sales. Buyers transact at their own risk. We strongly recommend conducting transactions in person in a safe location and verifying vehicle ownership via state motor vehicle registries before completing any sale.

We may charge fees for premium listings in the future. Any such fees will be communicated in advance.

8. Business Accounts

Business accounts are intended for legitimate automotive businesses. By creating a business profile you confirm that you are an authorised representative of that business. You agree to keep business information accurate and up-to-date.

Business accounts may not post misleading reviews, manufacture fake engagement, or use the platform for spam. Fuel price information displayed must reflect current pump prices.

9. Intellectual Property

All App code, design, trademarks, logos, and non-user content are the property of Apex Society Pty Ltd or its licensors. Nothing in these Terms grants you a right to use our trademarks or branding without prior written consent.

10. Privacy

Your use of the App is governed by our Privacy Policy, which is incorporated into these Terms. By using the App you consent to our data practices as described therein.

11. Disclaimers

The App is provided "as is" without warranties of any kind, express or implied. We do not warrant that the App will be error-free, secure, or available at all times.

We are not liable for the conduct of users or businesses on the platform, for the accuracy of listings, or for any loss arising from transactions conducted through the Marketplace.

12. Limitation of Liability

To the maximum extent permitted by Australian Consumer Law, our total liability to you for any claim arising from use of the App is limited to AUD $100 or the amount you paid us in the 12 months preceding the claim, whichever is greater.

13. Termination

We may suspend or terminate your account at any time for violation of these Terms. You may delete your account at any time via Settings > Account > Delete account. On deletion, your content will be removed within 30 days subject to legal retention obligations.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via in-app notification. Continued use after the effective date of changes constitutes acceptance.

15. Governing Law

These Terms are governed by the laws of Western Australia, Australia. Disputes shall be resolved in the courts of Western Australia unless otherwise required by applicable law.
