Privacy Policy

Apex Society Pty Ltd ("we", "us") operates the Apex Society mobile application. This Privacy Policy explains how we collect, use, disclose, and protect your personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

1. Who We Are

Apex Society Pty Ltd is registered in Western Australia, Australia. We operate the Apex Society mobile application available on iOS and Android.

2. Information We Collect

Account information: name, username, email address, and password when you register.

Profile information: bio, location, profile photo, garage (vehicles), and any other information you add to your profile.

Content: posts, photos, cruise details, marketplace listings, messages, and reviews you create.

Usage data: pages visited, features used, time spent in the App, crash reports, and device identifiers (device type, OS version, anonymous install ID).

Location data: precise GPS location only when you consent during cruise recording or route planning. Approximate location (suburb/city) may be inferred from IP address.

Business data: ABN, business name, address, phone, hours, and fuel prices for business accounts.

Payment data: We do not process payments directly. Any future payment processing will be handled by certified third-party processors (Stripe or equivalent). We do not store card numbers.

3. How We Use Your Information

We use your information to:

  • Provide, maintain, and improve the App
  • Enable you to create and manage your profile, garage, and listings
  • Show your location to cruise participants when you have enabled location sharing
  • Send push notifications for events, messages, and updates you have subscribed to
  • Detect and prevent fraud, abuse, and violations of our Terms
  • Comply with legal obligations
  • Aggregate and analyse anonymous usage data to improve features

We do not sell your personal information to third parties.

4. Information We Share

With other users: profile information, posts, and listings you make public are visible to other users per your privacy settings. Messages are visible only to participants.

With businesses: if you interact with a business profile, your display name and review content will be visible to that business.

With service providers: we share data with trusted providers who process it on our behalf (cloud hosting, analytics, push notifications). These providers are contractually bound to protect your data.

Legal requirements: we may disclose information to comply with a court order, law enforcement request, or to protect the rights and safety of users or the public.

Business transfers: in the event of a merger or acquisition, personal data may be transferred as a business asset, subject to the same privacy protections.

5. Location Data

Precise location is only accessed with your explicit permission. You can revoke location permission at any time in your device settings. Disabling location will prevent live route recording and some cruise features but will not affect general use of the App.

When you share your location during a cruise, your position is visible to other confirmed attendees of that cruise only. It is not visible to the general public.

6. Data Retention

We retain your personal information for as long as your account is active or as needed to provide services. If you delete your account, we will remove your personal data within 30 days, except where retention is required by law (e.g., financial records, safety incidents).

7. Data Security

We use industry-standard measures including encryption in transit (TLS 1.2+), encrypted storage, and access controls to protect your data. No method of transmission or storage is 100% secure. You use the App at your own risk and should use a strong, unique password.

8. Children's Privacy

The App is not directed at children under 16. We do not knowingly collect data from children under 16. If we become aware that we have collected data from a child under 16 without parental consent, we will delete it promptly.

9. Your Rights

Under Australian Privacy law you have the right to:

  • Access the personal information we hold about you
  • Request correction of inaccurate information
  • Request deletion of your data (subject to legal retention)
  • Opt out of direct marketing at any time
  • Lodge a complaint with the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au

10. Cookies & Tracking

The App uses local storage on your device to maintain session state and preferences. We may use anonymised analytics SDKs to understand aggregate usage patterns. We do not use advertising cookies or cross-site tracking.

11. Third-Party Links

The App may contain links to third-party websites or services. We are not responsible for the privacy practices of those third parties. We encourage you to read their privacy policies.

12. Changes to this Policy

We may update this Privacy Policy to reflect changes in our practices or legal requirements. We will notify you via in-app notice for material changes. The "Last updated" date at the top indicates when the policy was last revised.
